Copyright Registration in India | Saral Legal Solutions

COPYRIGHT REGISTRATION

Protect Your Original Creative Work

Copyright protects original creative works and gives authors and copyright owners legal rights over the use of their creations. Under Indian law, copyright generally arises automatically when an original work is created; registration is not mandatory for acquiring copyright. However, registration can provide important evidentiary advantages in disputes concerning ownership and the particulars recorded in the Register of Copyrights.

At Saral Legal Solutions, we assist authors, creators, businesses and copyright owners with copyright registration, legal advice and copyright-related disputes.

What Can Be Protected by Copyright?

The Copyright Act, 1957 provides protection to original works falling within specified categories, including:

  1. Literary works
  2. Dramatic works
  3. Musical works
  4. Artistic works
  5. Cinematograph films
  6. Sound recordings

Copyright protection generally concerns the expression of an idea rather than the idea itself. For example, copyright may protect the particular manner in which an article, photograph, video, software code or artistic work is created, but not merely the underlying idea or concept.

Is Copyright Registration Mandatory in India?

No.

Copyright protection generally arises automatically when an original work is created. There is no requirement to register a work merely to acquire copyright.

However, registration can be useful because the Register of Copyrights is prima facie evidence of the particulars entered in it under Section 48 of the Copyright Act, 1957.

Therefore, creators and copyright owners may consider registration as an additional measure for documenting their claim over a work.

Why Register Your Copyright?

1. Evidence of Ownership

Registration creates an official record of the particulars of the work in the Register of Copyrights. The entries in the Register are prima facie evidence of the particulars recorded therein.

2. Protection for Commercial Use

Copyright owners may license or assign their rights in accordance with law. A copyright owner may grant a licence in writing for use of the work and may receive licence fees or royalties under the terms of the arrangement.

3. Assistance in Copyright Disputes

Where unauthorised copying or use takes place, the copyright owner may have remedies available under the Copyright Act, including civil remedies such as injunctions and damages, subject to the facts and applicable law.

4. Record of the Work

Registration helps create a formal record containing relevant particulars relating to the work, author and copyright owner.

Copyright Infringement

Copyright infringement may arise when a person, without the requisite permission or licence and subject to statutory exceptions, undertakes an act restricted by copyright law.

Examples may include unauthorised:

  • Reproduction of a literary work
  • Copying of photographs or artwork
  • Use of copyrighted videos or films
  • Reproduction or use of music
  • Copying of software or source code
  • Publication of copyrighted material
  • Commercial use of copyrighted content

The Copyright Act also provides certain exceptions to infringement, so whether a particular use constitutes infringement depends on the facts and applicable statutory provisions.

What Can You Do in Case of Copyright Infringement?

Depending upon the circumstances, a copyright owner may consider legal action seeking appropriate remedies.

These may include:

Injunction

A court may, where legally warranted, restrain further unauthorised use, reproduction, publication or distribution of the copyrighted work.

Damages

A copyright owner may seek damages for loss caused by infringement, subject to the facts of the case and applicable law.

Other Legal Remedies

The Copyright Act provides various remedies and enforcement mechanisms depending upon the nature of the infringement.

Our legal team can examine the facts, ownership documents and nature of the alleged infringement and advise on the appropriate course of action.

Copyright Registration under Section 45

Section 45 of the Copyright Act, 1957 permits the author, publisher, owner or other person interested in the copyright in a work to make an application, in the prescribed form and with the prescribed fee, for entering particulars of the work in the Register of Copyrights.

The Copyright Office also provides an online filing facility for copyright applications. The official Copyright Office presently provides for registration applications through Form XIV and related prescribed documents.
